Welcome to www.LiberalEstates.org ("LiberalEstates"). LiberalEstates.org is provided to you by Liberal Estates&Cities Limited. The following General Terms of Use shall apply exclusively to the business relationship between LiberalEstates and its Internet platform www.liberalestates.org ("LiberalEstates" or “Service”) and the users of LiberalEstates (“User”) in the version applicable on the date of use. By accessing LiberalEstates, the User agrees to the following terms, as well as the manner in which LiberalEstates operates and is designed to make sure that everybody is liberal.  LiberalEstates does not recognise or accept any Terms of Use set by the User that differ from these unless LiberalEstates has agreed to their validity in writing.
 
 

Using LiberalEstates

 

We encourage our users to be
·         liberal, generous, honest and fair to everybody;
 
As a rule of use of LiberalEstates, you agree that you will:
·         NOT Violate any laws, posting rules or infringe any third-party rights, or bypass measures used to prevent or restrict access to LiberalEstates;
·         NOT Post any threatening, abusive, or indecent material;
·         NOT Distribute spam, chain letters or materials containing adult content or virus across our network or to any user
·         NOT Interfere with the infrastructure and activities of LiberalEstates;
·         NOT Collect, copy, modify, or distribute any other user’s materials or information without their permission;
·         NOT Use any automated means such as robot spider, crawler, scraper to access LiberalEstates and collect content for any purpose without our express written permission;
 
You are solely responsible for all information that you submit to LiberalEstates and any consequences that may result from your post. We reserve the right at our discretion to refuse or delete content that we believe is inappropriate or breaching the above terms. We also reserve the right at our discretion to restrict a user's usage of the site either temporarily or permanently, or refuse a user's registration.
 
 

Dealing with other members

Use of Content

 

 
LiberalEstates contains content from us, you, and other users. The images and logo are the copyright of the owners.
 
Throughout our website, trademarked names are indicated. However, rather that repeatedly show the trademark symbol, we state that we are using such names in an editorial content with no intention of infringement of that trademark.
 
All postings are the sole responsibility of the person from whom such post originated. However, Trademarked names, as always, remain the property of their respective companies.
 
We are liberal enough for you to use, download or print off copies of the content of this site (but save the tree, only print if it is necessary) for your personal, non-commercial, use and information.
 
Any copying or adaptation of the content, disassemble, decompile, reverse engineer or otherwise attempt to discover any source code layout/design or code of this site, or database or its contents, for any purpose, or other exploitation, without our specific consent will constitute copyright infringement.

Any member found to be spamming or having adult content posted may have their membership terminated immediately.

As your privacy is very important to us, we have established our Privacy Policy to explain how information is collected and used. 
 
 

LiberalEstates Participation and Disqualification

 

You may not use LiberalEstates if you are under the age of 13 or if your LiberalEstates membership has been suspended or terminated.

Each User may register only once, using their email address. During the registration process, the User must choose a user name or alias to protect their email address when bidding or listing an item. The user name or alias chosen must not offend standards of common decency or infringe upon the rights of third parties. Additionally, the use of misleading user names is strictly prohibited. LiberalEstates reserves the right to change or delete a user name if it finds User violating LiberalEstates’s Terms of Use. The associated password is to be kept secret by the User.
 
The User has to provide a legitimate email address during the registration process for LiberalEstates to authenticate the User and prevent future misuse of the service. We will also send the User the email for any notification. In general, the user shall be liable for all activities that are undertaken using the user account together with the associated password.

User accounts created during registration are non-transferable. Any abuse of the user account will inevitably result in the disqualification of the User and may lead to criminal proceedings. LiberalEstates may at any time, exercise sole discretion to suspend or permanently exclude users from it’s services. LiberalEstates will decide upon such exclusion if and insofar as, in the reasonable opinion of LiberalEstates, a user has breached a LiberalEstates provision, violated any laws or infringed upon the rights of third parties, or LiberalEstates has another justified interest in such for the protection of other Users or to prevent manipulation of any kind, for example if bids are not given, unauthorised bidding software is used, or several user accounts are set up by the same User.

Furthermore, LiberalEstates reserves the right in its absolute discretion to restrict the number of bids in which a User may participate or may win.
LiberalEstates has the right to disqualify a user and/or his winnings if LiberalEstates deems that a particular user or users have used unfair means to win an auction.
 
You will not hold LiberalEstates responsible for any loss you may incur as a result of using LiberalEstates.


 

 
The Asking Process

 

The asking price for ALL items is nil (ZERO). This means that all items should be given FREE of charge. An offer submitted by a user constitutes an offer from that User (or Giver) to offer the item out for free to another User (Taker). The giver will not be able to ask for an item listed by him. Each new offers starts off a new time ending time.  The item ending time for each of the item is shown on the screen. LiberalEstates reserves the right to change the times at any time. LiberalEstates can add or remove products from the LiberalEstates.org website at anytime without notice, including items which are already in progress.
 

Winning Mechanism:

 

The winning User is selected the user offering the item.
 
In the event of any dispute occurring, LiberalEstates’s decision on who the winner is, shall be final. 
 
Service:
 
While we will use our reasonable endeavours to maintain an uninterrupted service and continuous access to our services, we cannot guarantee this and we do not give any promises or warranties (whether express or implied) about the availability of our services. Operations of our sites may be interfered with by numerous factors outside of our control. In the event of any technical problem (third party or other) affecting the LiberalEstates.org platform, the countdown timers for all (or some) live items will be paused until the issue has been resolved. Item listings will continue once the system is brought back up. Should auctions close prematurely due to any technical problem, affected auctions may be reposted. Alternatively, LiberalEstates has the right to restart all item listings from the beginning, once the technical problem has been rectified.
 
 
Should LiberalEstates suspect that any unlawful action(s) or action(s) against its website, or Terms of Use; we may prosecute the perpetrator.
 
 

End of Bid Mechanism:

 

 
A bid is ended either when the time the giver specified at the time of entry had elapsed or the giver can no longer wait for the duration of the bid (a winner should be selected from the bidders) or LiberalEstates terminating the bid.
 
 

Notification, Acceptance and Postage

 

After the auction has ended and the winner is selected, all the users who signifies their interest in the item will receive notifications. The winner will then receive an email with the information needed to collect the item such as the contact details of the giver. This information will also be available on the My LiberalEstates page of the User. LiberalEstates may recommend some related services to the bidders in the emails. In the event that the winner has not confirmed an interest to take the item within 24 hours of the item listing ending and the giver is not willing to wait, another user can be selected and notified.
 
 

Delivery and Postage Payment

 

 Unless otherwise agreed, the taker will pick up the item from the giver house or make alternative delivery arrangement with the giver. If the winner agrees to pay for postage (which should be reasonable) through our service and the giver agrees to post the item, the giver will post the item as soon as LiberalEstates confirms that the postage has been paid by the taker. The giver will receive the delivery fee when the winner confirms the receipt of the item. LiberalEstates may involve a third party in delivery of the item. LiberalEstates is not liable for any payment made or not made by users.
 
The item descriptions on LiberalEstates.co.uk are provided according to the best ability of the User and might not constitute contractually stipulated features and characteristics, but rather serve only to provide information. Images of products may differ from those actually supplied.
 
 

Cancellation Instructions

 

You may cancel or withdraw your bid or post before the bid ends. A bid that has ended CANNOT be cancelled.


 
 

Rating system

 

Only the members involved in a transaction may post a rating. Only the winning user may rate the giver and the giver rating the winner.
 
 

Changes

 

We are continually seeking to update and improve the site. Therefore, we may make changes to any part of the site and these conditions and you will be bound by changes to these conditions from the time you next access the site.
 
 
 

General Safety

 

 
Be aware! It is the responsibility of each User when arranging for pickup of any item to be appropriately aware of the potential risk of having a stranger come to your home to pick something up or going into somebody’s home. LiberalEstates assumes no responsibility for this risk. If you are concerned about meeting people when alone in the house, you could arrange for a drop-off in town, or leave the item at your door-step, or have a friend or relative with you.
 
 

Downloads

 

You must ensure that any item taken from any user of this service is suitable for your use. This applies to any software downloaded from this site so you must check all your software loaded from this site and ensure it is compatible with your computer and are virus free.
 


Disclaimer

 

We cannot guarantee that the use of the site will not be interrupted or unavailable due to any factors outside our control.
 
All content on the LiberalEstates website is not intended to amount to advice on which reliance should be placed. LiberalEstates disclaims to the fullest extent permitted by law all liability and responsibility arising from any reliance placed on such materials by any visitors to the LiberalEstates website or by anyone who may be informed of any of its contents.
 
We reserve exclusive right at our sole discretion to alter, limit or discontinue part of this site.
 
Under no circumstances shall we be liable for any loss, damage or liability or expense suffered which is claimed to result from the use of this site, including without limitation, any fault, error, omission, interruption or delay. Use of this site is at the user’s sole risk. Users specifically acknowledge and agree that we are not liable for any conduct of any other user.
 
We reserve the right to deny at our sole discretion any user access to this site or any portion thereof without notice. We have no obligation to forward any unread or unsent messages to you or any third party.
 
Any rights not expressly granted in these terms are reserved.
 
 
Should you object to any these Terms of Use, your only recourse is to immediately cease from using the Service.
